The Field General Sites are owned and operated by Pro Athlete, Inc. and include FieldGeneral.com.  As used herein, use of the term "Field General" includes "Pro Athlete, Inc.". Field General may also be referred to herein as the "Field General Sites", "Site," "Sites," "us," "our" or "we". Field General created these Terms of Use.

Please read these Terms of Use and Privacy Policy ( "Terms of Use ") carefully before using any of the Field General Sites, including but not limited to the purchase of Field General products or services. By using the Field General Sites or by selecting a box that states you accept these terms, you indicate your agreement to these Terms of Use. You also represent that you are at least 18 years old, or you are at least the minimum legal age to enter into a contract, in the jurisdiction in which you are using the Field General Sites. You agree to these Terms of Use to use any of the Field General Sites.

You acknowledge that these Terms of Use are supported by reasonable and valuable consideration. You acknowledge that such consideration includes your use of the Sites (including but not limited to the purchase of Field General products or services), the collection of data, materials and information available at or through our Sites, the possibility of our use or display of your Submissions (as defined below) and the possibility of promotion from our use or display of your Submissions.

Orders Field General does sell products for children, but it does not sell products to children. Field General only sells products to adults, ages 18 and older, who may purchase products with a credit card. Field General reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders in its sole discretion, including, without limitation, if Field General believes that user conduct violates applicable law or is harmful to the interests of Field General, its affiliates, or other customers.

Intellectual Property Information The Field General name and logo are trademarks or registered trademarks of Pro Athlete, Inc., Field General and/or their parent, subsidiaries and/or affiliates.

Note that any program, publication, design, product, process, software, technology, information, know-how or idea described in this website may be the subject of other rights, including other intellectual property rights, which are owned by Field General or other interested parties and are not licensed to you hereunder. This includes all images, text, programs, graphics, interactive clips and other materials that are on this website.

All copyright rights in the text, images, photographs, graphics, user interface, and other content provided on the Sites, and the selection, coordination, and arrangement of such content, are owned by Field General, its affiliates or its third-party licensors to the full extent provided under the United States Copyright Act and all international copyright laws. Under the applicable copyright laws, you are prohibited from copying, reproducing, modifying, distributing, displaying, performing, or transmitting any of the contents of the Site for any purposes. Nothing stated or implied on the Sites confers on you any license or right under any copyright of Field General or any third party.

The Sites and the information contained on the Sites are for your personal, non-commercial use only. License and Access to Field General Field General grants you a limited license to access and make personal use of the Sites, and not to download or modify them, or any portion of them, except with the express written consent of Field General.

Submissions "Submissions" refer to text, comments, messages, ideas, concepts, suggestions, and/or other similar materials that a user posts, submits, or distributes on or through a Field General site. You hereby grant Field General a perpetual, non-exclusive, irrevocable, royalty-free license to display, reproduce, and exploit such Submissions in all media formats for purposes including news, advertising, and marketing.

Interactive Areas The "Interactive Areas" (chats, personal ads, features) are for public communications. You acknowledge that use of, or reliance upon any Submission posted in any Interactive Areas is at your own risk. We are not responsible for, and we do not endorse, the opinions or advice posted by users.

Community Guidelines You may not post junk mail, spam, or commercial offers. You may not use obscene, indecent, or offensive language or provide material that is defamatory, abusive, harassing, or threatening. You agree to refrain from ethnic slurs, religious intolerance, homophobia, and personal attacks. You agree not to disrupt, attack, modify, or interfere with the Sites or associated software and hardware.

Your Responsibilities You warrant that you will not use the Sites for any purpose that is unlawful. You will pay all charges incurred by users of your credit card or other payment method at the prices in effect when such charges are incurred.

Risk of Loss All products purchased from Field General are transported and delivered to you by an independent carrier. Title to products, as well as the risk of loss, passes to you when Field General delivers these items to the independent carrier.

Product Information Field General strives to provide the most accurate and up-to-date information. We do not warrant that the product descriptions or other content are error-free. All prices are quoted in U.S. Dollars.

Disclaimer of Warranties and Limitations on Liability THE FIELD GENERAL SITES AND ALL PRODUCTS AND SERVICES ARE PROVIDED ON AN "AS IS " AND "AS AVAILABLE " BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIELD GENERAL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT WILL FIELD GENERAL BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF THE SITES.

Indemnification You agree to defend, indemnify and hold harmless Field General, its parent, subsidiaries, and affiliates from and against all claims, losses, costs, and expenses arising out of your activities in connection with the Sites or your violation of these Terms of Use.

Applicable Law and Dispute Resolution This Agreement will be governed by the laws of the State of Missouri. Any dispute relating to your visit to Field General or to products you purchase shall be submitted to confidential and binding arbitration in Kansas City, Missouri, USA.

Miscellaneous Legal Provisions This Agreement is the entire and final Agreement regarding the Field General Sites and supersedes any prior communications. All rights not expressly granted herein are hereby reserved.
